These Terms of Use ("Terms") govern your access to and use of the Overpass website, applications, and services ("Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who We Are

Overpass Digital LLC ("Overpass," "we," "us," "our") is a Delaware limited liability company providing access to AI-powered tools that allow users to generate synthetic AI images and other AI-generated content ("Output").

2. Eligibility and Account Registration

A. Minimum Age — 18+ Only

The Services are intended only for adults aged 18 or older.

By using the Services, you represent and warrant that:

• You are 18 years of age or older
• You will not allow minors to access or view the Services
• Accessing adult-oriented AI content is legal where you reside
• Accounts found to belong to users under 18 will be terminated

B. Account Registration

To access our Services, you must create an account using:

• A valid email address
• A password

You are responsible for all activity under your account and for safeguarding your login credentials. Account sharing, transfers, or creation on behalf of minors is not permitted.

3. Using the Services

A. Permitted Use

You may use the Services to:

• Interact with AI models
• Generate synthetic Output
• Access subscription features
• Use other tools we provide

You must comply with these Terms and all applicable laws.

B. Prohibited Content and Conduct

You may not request, input, generate, or distribute any content that is illegal, violates these Terms, or violates any applicable card association or payment network standards (including but not limited to Visa, Mastercard, and their member financial institutions). Violation may result in immediate account termination, content removal, and reporting to appropriate authorities.

1. Absolutely No Content Involving Minors

Strictly forbidden:

• Any real, fictional, stylized, or AI-generated individual under 18
• Any depiction or implication of a minor in sexual, nude, erotic, or suggestive scenarios
• Use of terms implying youth (e.g., "teen," "underage," "schoolgirl," "barely legal")
• Adults "roleplaying" or being described as minors

2. Non-Consensual or Exploitative Content

Including:

• Coercion, force, threats, assault, or manipulation
• Incapacitated, asleep, unconscious, or intoxicated individuals
• Hidden-camera, voyeurism, or "revenge porn" scenarios
• Non-consensual deepfakes

3. Incest or Familial Relationships

Including:

• Parent/child
• Sibling or step-sibling
• Any sexualized content involving family or step-family roles

4. Bestiality

No sexual content involving animals (real, fictional, or anthropomorphic).

5. Violence or Harm

Including:

• Physical harm, torture, mutilation, or "snuff" scenarios
• Sexual violence
• Gore or injury fetish content
• Extreme humiliation

6. Trafficking, Exploitation, or Forced Activity

Including:

• Human trafficking themes
• Forced labor or sexual slavery
• Prostitution solicitation
• "Buying/selling/owning" individuals

7. Drug Use or Dangerous Acts

Including:

• Sex involving illegal substances
• Forced intoxication
• Knife play or gun play
• Use of dangerous weapons in sexual contexts

8. Public Sexual Activity

Including explicit acts in public settings or where bystanders could be present.

9. Hate or Discriminatory Content

Including:

• Racial or ethnic degradation
• Fetish content rooted in hate, degradation, or discrimination

10. Real Individuals Without Consent

Including:

• Sexualized depictions, deepfakes, or portrayals of real people
• Celebrities, co-workers, acquaintances, or private individuals

11. Extreme or Medical Fetish Content

Including:

• Needles, surgeries, or invasive medical tools
• Scat, urine, vomit, or bodily fluids

12. Illegal Activity

Including:

• Drug distribution
• Weapons trafficking
• Any content that promotes unlawful behavior

13. Technical Misuse

Including:

• Uploading any media (images)
• Attempting to bypass safety filters
• Reverse engineering, scraping, or automating requests
• Attacking, disrupting, or interfering with the Services

14. Card Association and Payment Network Violations

Any content that violates the standards, rules, regulations, or policies of any applicable card association or payment network, including but not limited to Visa, Mastercard, and their member financial institutions, is strictly prohibited, whether or not such content is explicitly listed above.

C. Feedback

You grant Overpass the right to use any feedback you provide without restriction or compensation.

4. Content

A. Input

You may provide text-only Input. You represent that you have the right to provide it.

Uploads of images or other media files are prohibited.

B. Ownership of Output

You:

• Retain ownership of your Input
• Own Output generated from your Input
• Acknowledge Output may resemble content seen by other users

We assign you all rights we may have in Output.

C. Our Use of Content

We use Content only to:

• Operate and maintain the Services
• Display Output to you
• Enforce safety, detect abuse, and comply with law
• Investigate violations

We do not use your Content to train AI models.

D. Accuracy Disclaimer

AI Output may be inaccurate, offensive, or misleading. You agree:

• Not to rely on Output as factual or professional advice
• To review and evaluate Output before using or sharing it

E. AI-Generated Content Disclaimer (No Real Persons)

All content generated through the platform is fully AI-generated and synthetic. Any individuals depicted in AI-generated content are entirely fictional and do not represent real persons, whether living or deceased.

5. Content Review and Removal

Overpass reserves the right to review, disable, or remove any content at any time if it is believed to violate these Terms, applicable law, or platform policies, or if concerns are raised regarding rights, consent, age, or identity.

Content subject to review may be temporarily disabled pending investigation.

Users may report concerns or request removal by contacting support@tryoverpass.com or by using the in-app report feature.

Upon receipt of a report, the content is immediately taken down and placed into a pending review state, where it is reviewed by our moderation team to determine whether permanent removal or other action is required. All reported complaints are reviewed and resolved within five (5) business days or sooner.

6. Subscriptions and Billing

A. Payments

All billing, payments, and refunds are handled exclusively by our third-party payment processor. We do not store complete payment card information.

B. Prices

• Monthly Plan: $14.99/month
• Yearly Plan: $143.88/year ($11.99/month, 20% discount)

C. Automatic Renewal

Subscriptions renew automatically until cancelled. You authorize recurring charges.

D. Cancellation

You may cancel any time. Your subscription remains active until the end of the paid period.

E. Refunds

All refunds are processed solely through our payment processor's policies.

F. Chargebacks and Fraud Prevention

Excessive chargebacks, payment disputes, refund abuse, or suspected fraudulent activity may result in immediate suspension or termination of your account, without refund. Overpass reserves the right to take reasonable steps to prevent fraud, protect the integrity of the payment system, and comply with card network and payment processor requirements.

7. Law Enforcement and Regulatory Cooperation

Overpass reserves the right to cooperate with law enforcement, regulatory authorities, court orders, subpoenas, or other legal processes, including by providing account information, content, or activity records where required by applicable law. We may take such actions without prior notice to the user when legally permitted.

8. No Professional Advice; No Fiduciary Relationship

The Services and any Output generated through them do not constitute legal, medical, financial, or professional advice of any kind. Overpass does not act as a fiduciary, advisor, or agent for any user. You acknowledge that no fiduciary or special relationship is created between you and Overpass through your use of the Services.

9. Artificial Intelligence Limitations

Output is generated by automated artificial intelligence systems and may be inaccurate, incomplete, offensive, misleading, or inappropriate. Overpass makes no representations regarding the accuracy, reliability, or suitability of any Output. You agree not to rely on Output for decision-making or actions that could result in harm, loss, or legal consequences.

10. Responsibility for Use of Output

You are solely responsible for how you use, publish, distribute, or otherwise rely on Output generated through the Services, including ensuring compliance with all applicable laws and regulations.

11. Immediate Suspension Without Notice

Overpass may suspend or terminate access to the Services immediately and without prior notice if we reasonably believe there has been a violation of these Terms, applicable law, or platform safety requirements.

12. Termination

We may suspend or terminate your account if:

• You violate these Terms
• You attempt to generate prohibited content
• You engage in fraudulent or harmful activity
• Required by law
• Your account is inactive for more than one year

You may stop using the Services at any time.

13. Discontinuation of Services

We may discontinue or modify the Services. If so, you will receive a refund for unused prepaid services.

14. Disclaimer of Warranties

The Services are provided "as is." We make no warranties of any kind, express or implied.

You use Output at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability will not exceed the greater of:
• Amount paid in the past 12 months, or
• $100

16. Indemnification

If you use the Services on behalf of a business, you will indemnify and hold Overpass harmless from claims arising from:

• Your use of the Services
• Your violation of these Terms

17. Dispute Resolution

A. Informal Resolution First

Both parties agree to attempt good-faith informal resolution for 60 days before arbitration.

B. Binding Arbitration

Disputes will be resolved by binding arbitration under the Federal Arbitration Act.

C. Class Action Waiver

You waive rights to:

• Class actions
• Group arbitration
• Representative actions

D. Opt-Out

You may opt out of arbitration within 30 days of account creation by emailing support@tryoverpass.com.

18. Copyright Complaints (DMCA)

20. General Terms

• You may not assign your rights
• We may update these Terms; material changes include 30 days' notice
• Invalid provisions do not affect the remainder
• You must comply with export laws
• These Terms constitute the entire agreement
• Governing law: Delaware, excluding conflicts rules
